VIVA PIMA! Online Store Terms of Service

These Terms of Service govern your use of the VIVA PIMA! website and online shop and purchases made through it. The shop is operated by VIVA PIMA!, Inc., an Arizona nonprofit corporation (“VIVA PIMA!,” “we,” or “us”) and hosted on Shopify. Please read these Terms and the policies linked below before ordering. By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website or online shop.

1 Shop access and accounts

You may use the website only for lawful purposes. If you place an order, you must be able to enter into a binding contract or have the consent of a parent or legal guardian. Please provide accurate contact, billing, payment, and delivery information. If you create an account, you are responsible for keeping your credentials secure and for activity through your account. Contact us promptly if you suspect unauthorized use.

2 Pre-owned merchandise and listings

Unless a listing says otherwise, merchandise in our online shop is donated and pre-owned. Items may show age, wear, prior use, or imperfections. We make reasonable efforts to photograph and describe known material condition issues, but images and descriptions may not reveal every detail. Colors may look different on different screens. Please review the listing, measurements when provided, fulfillment options, and photographs before purchasing; contact us if you need more information.

Most items are one of a kind and available in a quantity of one. An item shown online may occasionally become unavailable before an order is fulfilled. We may correct listing errors, remove an item, or cancel an order when an item is unavailable or materially misdescribed; if payment has been collected for a canceled order, we will refund it.

UNLESS A PRODUCT LISTING EXPRESSLY PROVIDES OTHERWISE, PRE-OWNED MERCHANDISE IS SOLD AS IS, WITH ALL FAULTS, TO THE EXTENT PERMITTED BY APPLICABLE LAW. This does not limit rights that cannot legally be waived or our obligations under our Return and Refund Policy.

3 Orders and payment

Submitting an order is an offer to purchase. An automated order acknowledgment does not necessarily mean we have accepted the order. We accept an order when we confirm that it will be fulfilled. We may decline or cancel an order because of an inventory discrepancy, pricing or listing error, suspected fraud, or other legitimate reason. We will try to contact you using the information supplied with your order and will refund any payment collected for an order we cancel.

The price shown at checkout, together with applicable taxes and any shipping charges, is the amount charged. Prices and promotions may change before an order is placed. You must be authorized to use the payment method you provide. We may be unable to cancel or change an accepted order once fulfillment begins.

Returns and exchanges are governed by our Return and Refund Policy. Please review it before ordering.

4 Pickup and shipping

Fulfillment methods available for an item are shown during shopping or checkout. We will notify you when a pickup order is ready. Shipping and pickup time frames are estimates, and carrier transit times may vary. If your order is lost, damaged, or substantially delayed, contact us promptly so we can investigate and help address the issue. Please retain packaging and photographs of shipping damage where possible.

5 Website content and acceptable use

The website’s text, photographs, graphics, logos, and other content belong to VIVA PIMA! or their respective owners and may be protected by intellectual property law. You may view the site and use its content for personal shopping and ordinary noncommercial reference. You may not reproduce substantial site content or use our names and logos without permission, except where the law permits.

You may not interfere with site security or operation; upload malicious code; misuse another person’s account or personal information; impersonate anyone; submit false or unlawful content; or use automated means to access the site in a manner that disrupts it. We may restrict access when reasonably necessary to protect the shop, its customers, or the organization.

6 Customer reviews and feedback

We welcome honest feedback, including criticism. You retain ownership of reviews, comments, photographs, and other content you submit. If you submit content for publication on our website or social channels, you grant VIVA PIMA! a nonexclusive, royalty-free permission to display, reproduce, and reasonably edit it for length or formatting in connection with our shop and nonprofit activities. We will not materially alter the meaning of a review. Private messages sent to customer service are not treated as permission to publish your name, message, or image; we will seek your permission before using them publicly.

Please submit only content you have a right to share, and disclose any incentive you received for a review. We may remove content that is unlawful, fraudulent, abusive, invasive of privacy, or unrelated to a genuine customer experience. Nothing in these Terms restricts your right to express an honest opinion about VIVA PIMA! or its products.

7 Third-party services and privacy

Shopify hosts our online shop, and payment, delivery, and other service providers may assist with transactions. Purchases from this shop are made from VIVA PIMA!, not Shopify. Links to independent websites are provided for convenience; their content and practices are controlled by their operators.

8 Warranties and liability

We work to keep the site accurate and available, but cannot promise uninterrupted or error-free access. To the extent permitted by law, the website is provided as available, without implied warranties concerning its operation. Product warranties, if any, will be stated in the applicable listing. The condition and AS IS provision in Section 2 apply to pre-owned merchandise.

To the extent permitted by law, VIVA PIMA! is not responsible for indirect, incidental, special, or consequential losses arising from use of the website or an order. Nothing in these Terms excludes liability or consumer rights that applicable law does not permit us to exclude, including liability for our own fraud or willful misconduct. If a problem arises with an order, please contact us so we can address it under the applicable policy and law.

9 Changes and governing law

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively, and the Terms in effect when you place an order govern that order unless applicable law requires otherwise. We will provide any additional notice required by law for material changes.

Arizona law governs these Terms, without regard to conflict-of-law rules, except where applicable law provides otherwise. Subject to applicable law, disputes concerning these Terms or the online shop may be brought in state or federal courts serving Pima County, Arizona. If a provision cannot be enforced, the remaining provisions remain effective. Our failure to enforce a provision on one occasion is not a waiver of it.
